This is an opportunity for citizens to speak to the City Council for up to 5 minutes on items not on the Agenda, but within the City Council's jurisdiction. The Council is prohibited by law from discussing or taking immediate action on non-agendized items.
A.Public Communications
CONSENT CALENDAR:
All matters listed under CONSENT CALENDAR will be enacted by one motion in the form listed below. There will be no separate discussion on these items prior to the time Council votes on them, unless a member of the Council requests a specific item be removed from the Consent Calendar for discussion. Does any member of the public wish to address the City Council regarding any item on the Consent Calendar before the vote is taken?
A.Approval of Minutes
Approve the Minutes of the June 25, 2013, Regular City Council Meeting.
B.Award of Construction Contract for Randall Avenue, Locust Avenue and Armstrong Road Pavement Rehabilitation Project SB-08-PW-13
1.   Award bid and authorize the City Manager to enter into a new construction contract with All American Asphalt in the amount of $680,000 for the Randall Avenue, Locust Avenue and Armstrong Road Pavement Rehabilitation Project SB-08-PW-13 and authorize a 10% construction contingency amount of $68,000.

2.   Authorize the Public Works Director to implement temporary road closures and detours to accommodate the construction activities.     
C.Award of Contract for Community Development Block Grant Concrete Improvement Project SB-05-PW-13
1.   Award Bid and authorize the City Manager to enter into a new construction contract with Carvajal Trucking and Tractor, Inc. for the Community Development Block Grant (CDBG) Concrete Improvement Project SB-05-PW-13 in the amount of $193,370.10 and authorize a 10% construction contingency amount of $19,337.

2.   Authorize the Public Works Director to administratively approve and implement temporary street closures and detours during construction.  
D.Amendment No. 1 to Funding Agreement with Caltrans for the I-15/Duncan Canyon Interchange Project
Approve Amendment No. 1 to Funding Agreement 08-1516 for the I-15/Duncan Canyon Interchange project.
E.Fontana After School Program - ASES Proposition 49
1.   Approve the renewal of a two year agreement between the Fontana Unified School District (FUSD) and the City of Fontana to operate twenty-eight elementary schools and five middle schools grant-funded after school programs. The total grant funding for these programs is $3,257,920 annually.

2.   Authorize the City Manager or designee to sign the agreement, all related documents, and any amendments for the term of the agreement.
F.Department of Alcoholic Beverage Control Grant
1.   Accept the Department of Alcoholic Beverage Control Minor Decoy, Shoulder Tap, IMPACT (Informed Merchants Preventing Alcohol-Related Crime Tendencies)/ROSTF (Retail Operating Standards Task Force), E.R.A.S.E. (Ensuring Responsible Alcohol Sales Education) Grant in the amount of $23,113.

2.   Authorize the Chief of Police to sign the ABC Grant Contract.

3.   Approve the expenditure plan for the use of the funds and authorize appropriate budget entries increasing both the estimated revenues and appropriations in Grant Fund #301, Budget Unit # 40423301.
G.Exclusive Use Agreement with Fontana Unified School District
Authorize the City Manager to enter into a 5 year agreement with Fontana Unified School District (FUSD) for exclusive off-hours use of the sports fields at Fontana Middle School, Alder Middle School, and Wayne Ruble Middle School.
Approve Consent Calendar Items as recommended by staff.
PUBLIC HEARINGS:
To speak on Public Hearing Items, fill out a card at the microphone stand indicating favor or opposition and give it to the City Clerk. Each person will be allowed 5 minutes to address the Council. If you challenge in court any action taken concerning a Public Hearing item, you may be limited to raising only those issues you or someone else raised at the Public Hearing described in this notice or in written correspondence delivered to the City at, or prior to, the Public Hearing.

A.Zoning Code Amendment (ZCA) No. 13-002, Cottage Food Operations
1.   Find that the project is exempt pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA), and direct staff to file the Notice of Exemption.

2.   Waive further reading of and introduce Ordinance No. ____, an ordinance of the City Council of the City of Fontana, California, Amending Chapter 30, Zoning and Development Code Article V, Division 3 (Use Regulations) and Article II Division 12 (Home Occupation Permit), of the Fontana City Code, allowing Cottage Food Operations as a permitted use in the residential zoning district with the approval of a home occupation permit; and that the reading of the title constitutes the first reading thereof.
NEW BUSINESS:
A.Issuance of Special Tax Bonds for CFD #70 Avellino
Adopt Resolution No. 2013-____ of the City Council of the City of Fontana authorizing the issuance of City of Fontana Community Facilities District No. 70 (Avellino) Special Tax Bonds, Series 2013, in an aggregate principal amount of not to exceed $3,500,000, authorizing the execution and delivery of an Indenture, a Bond Purchase Agreement and a Continuing Disclosure Agreement, authorizing the distribution of an Official Statement in connection therewith and authorizing the execution of necessary documents and certificates and related actions.
B.Bath Salts Ordinance
Waive further reading of and introduce Ordinance No. ____ of the City Council of the City of Fontana, California, adding Chapter 16, Article V, Division 1 to the Fontana Municipal Code regarding Bath Salts; and that the reading of the title constitutes the first reading thereof.
