This is an opportunity for citizens to speak to the City Council for up to 5 minutes on items not on the Agenda, but within the City Council's jurisdiction. The Council is prohibited by law from discussing or taking immediate action on non-agendized items.

CONSENT CALENDAR:
All matters listed under CONSENT CALENDAR will be enacted by one motion in the form listed below. There will be no separate discussion on these items prior to the time Council votes on them, unless a member of the Council requests a specific item be removed from the Consent Calendar for discussion. Does any member of the public wish to address the City Council regarding any item on the Consent Calendar before the vote is taken?
A.Approval of Minutes
Approve the Minutes of the August 27, 2013 Regular City Council Meeting. 
B.Fontana Art Association Quarterly Report
Accept staff report.
C.Award of Construction Contract for Southridge, Locust/Barbee Sanitary Sewer Lift Station Rehabilitation Project SB-50-PW-13
1.  Award bid and authorize the City Manager to enter into a construction contract with HPS Mechanical, Inc. for the Sanitary Sewer Pump Station Repairs SB-50-PW-13 in the amount of $1,160,450 and authorize a 10% construction contingency amount in the amount of $116,045.

2.  Authorize the Public Works Director to implement temporary road closures and detours to accommodate the construction activities as necessary.   
D.Contract for Report Writing Services - Maria Hallasgo
Authorize the City Manager to enter into a Professional Services Agreement with Maria Hallasgo for directed computer report writing services in an amount not to exceed $40,000.
Approve Consent Calendar Items as recommended by staff.
PUBLIC HEARINGS:
To speak on Public Hearing Items, fill out a card at the microphone stand indicating favor or opposition and give it to the City Clerk. Each person will be allowed 5 minutes to address the Council. If you challenge in court any action taken concerning a Public Hearing item, you may be limited to raising only those issues you or someone else raised at the Public Hearing described in this notice or in written correspondence delivered to the City at, or prior to, the Public Hearing.

A.Hearing to Determine Number of Taxicab Franchise Permits to be Issued
Determine whether the public convenience or necessity requires additional Taxicab Franchise permits beyond the two currently approved.
B.Consolidated Annual Performance Evaluation Report (CAPER) Fiscal Year 2012-2013
Conduct a public hearing on the Consolidated Annual Performance and Evaluation Report (CAPER) prepared for the U.S. Department of Housing & Urban Development to report on housing assistance and community development activities undertaken by the City of Fontana during Fiscal Year 2012-2013 and authorize the City Manager to execute any documents necessary to submit the report, along with any comments received during the public hearing and public comment period, to the Department of Housing & Urban Development.
C.Adopt a Resolution to Vacate a Public Easement
1.  Adopt Resolution No. 2013-_____  of the City Council of the City of Fontana, California, vacating a public easement known as a twenty-foot wide alley on the north end of Tract 3894, pursuant to Streets and Highways Code Section 8320, et. Seq.  
 
2.  Find that the project is exempt from further environmental review pursuant to Section 15332 of the California Environmental Quality Act where it can be seen with certainty that there is no possibility of significant effects upon the environment, and direct staff to file a Notice of Exemption.   
NEW BUSINESS:
A.R66 Helicopter Purchase
1.  Adopt Resolution No.2013-_______of the City Council of the City of Fontana, California approving the purchase of one Robinson R66 Police Edition Helicopter and associated equipment for the police department air support unit.

2.  Approve the purchase of updated safety and mapping equipment for current Robinson R66 helicopter.

3.  Approve appropriation and allocate the amount of $210,000 from Fund 223 “Federal Asset Seizure” and authorize the City Manager or his designee to execute all related contract documents.

Taylor Council Chambers at 8353 Sierra Avenue, Fontana, California.
