A.Approval of Minutes
Approve the Minutes of the September 23, 2014 Regular City Council Meeting.
B.Acceptance of Final Map for Tract No.'s 18244 and 18245 within the Providence Pointe Specific Plan
Accept Final Map for Tract No's. 18244 and  18245 located within the Providence Pointe Specific Plan, north of Baseline Avenue and west of Citrus Avenue; accept as public dedicated streets and easements; and authorize the City Manager to enter into a Subdivision Agreement with the subdivider for said tracts. 
C.Approve a Development Impact Fees Credit Agreement with Lennar Homes for Tract No. 17165 Located South of Casa Grande and West of Cypress Avenue
Authorize the City Manager to execute a Partial Satisfaction of Development Impact Fees Credit Agreement with Lennar Homes of California, Inc. for Tract No. 17165 located south of Casa Grande Avenue and west of Cypress Avenue.
D.Award Bid for CCTV Storage System, SB-05-IT-15
Award competitive bid SB-05-IT-15 to Golden Star Technology (GST) in the amount of $54,226.20 for replacement of the City of Fontana's Closed Circuit Television (CCTV) video storage system.
E.Award Contract for the General Plan and Zoning and Code Update (SP-59-DS-14) (Continued from September 23, 2014 City Council Meeting)
1.  Award Contract for the General Plan and Zoning and Code Update (SP-59-DS-14) to Raimi and Associates in the amount of $1,499,602.

2.  Authorize the City Manager to enter into a contract with Raimi and Associates.
F.Award Bid for Server Equipment Replacement, SB-08-IT-15
Award the competitive bid SB-08-IT-15 to Cyber Computers in the amount of $120,472.50 for the replacement of the Server Equipment in use by the City of Fontana and Fontana Police Department.
G.Adopt an Amended 2014 Conflict of Interest Code
Adopt Resolution No. 2014 - ___ of the City Council of the City of Fontana, California, approving and adopting an Amended Conflict of Interest Code pursuant to the Political Reform Act of 1974.
H.Adopt Resolution of Intent to Set a Public Hearing to Sell Surplus Property (Three Remnant Parcels Located West of Citrus Avenue, South of Walnut Avenue within Tract No. 17389)

1.  Adopt Resolution No. 2014-_____, a resolution of the City of Fontana declaring its intention to sell surplus land, located on LCPL Fernando Temayo Way, commonly known as Assessor Parcel Numbers 0228-151-60, 0228-151-61 and 0228-151-63, and to set a public hearing for the consideration of protests. 

2.  Set the public hearing for October 28, 2014, for the consideration of the sale of surplus property located on LCPL Fernando Temayo Way.

I.Authorize Amendment No. 3 to the Construction Management Contract for the I-15/Duncan Canyon Interchange Project
Authorize the City Manager to execute Amendment No. 3 to the Construction Management Contract with Caltrop Corporation for Construction Management Services for the I-15/Duncan Canyon Interchange Project in accordance with the construction survey proposal, for an increase of $873,000.00 and a total not-to-exceed amount of $4,044,316.21.
J.Adoption of Resolution of Intent and to Set the Public Hearing on Establishing Community Facilities District No. 79M for Street Lighting, Landscaping and Park Maintenance for the Apartment Complex Located at 16829 San Bernardino Avenue
1.  Adopt Resolution No. 2014-____ of Intention of the City Council of the City of Fontana with respect to Establishment of Proposed Community Facilities District No. 79M of the City of Fontana. 

2.  Set the Public Hearing for November 25, 2014, for the Formation of the District and Call the Special Election for November 25, 2014. 
K.Police Department Sewer Pump Station Design and Construction
1.  Award a contract to Schaaf & Wheeler, Consulting Civil Engineers to provide complete design documents and construction management for the Police Department Pump Station.

2.  Authorize the City Manager to piggy-back off of the City of Oakland's bid and to enter into a professional services agreement with Schaaf & Wheeler Consulting Civil Engineers in the amount of $78,570.    
L.Resolution Denying Appeal of Cost Confirmation Award – 7371 Oleander Ave., Fontana California
Adopt Resolution No. 2014-____ of the City Council of the City of Fontana, California, denying the appeal of appellant and upholding the decision of the hearing officer regarding code enforcement costs confirmation hearing concerning certain real property located at 7371 Oleander Ave., Fontana California. 
M.Settlement Agreement Resolving Sewer Agreement Lawsuit with City of Rialto
Approve a Settlement Agreement, resolving the Sewer Agreement Lawsuit involving the City of Rialto and authorize the City Manager to sign said Settlement Agreement. 
Approve Consent Calendar Items as recommended by staff.

A.Issuance of 2014 Lease Revenue Refunding Bonds
Adopt Resolution No. 2014-_____ of the City Council of the City of Fontana authorizing the execution and delivery by the City of a Ground Lease, Lease Agreement, Indenture, Escrow Agreement, Continuing Disclosure Certificate and Bond Purchase Agreement in connection with the issuance of Fontana Public Facilities Financing Authority Lease Revenue Refunding Bonds, Series 2014A, approving the issuance of such bonds in an aggregate principal amount of not to exceed $44,000,000, authorizing the distribution of an Official Statement in connection with the offering and sale of such bonds and authorizing the execution of necessary documents and certificates and related actions.
B.Appeal No. 14-001 is a Request to Overturn the Planning Commission’s Decision on August 5, 2014, denying a 97-lot Medium Density Single-Family Residential Project Located on the Southwest Corner of Sierra Lakes Parkway and Beech Avenue (Centerstone Communities) (General Plan Amendment No. 13-003, Zone Change No. 13-005, and TTM No. 18881)
Deny Appeal No. 14-001, upholding the Planning Commission’s decision on August 5, 2014, denying General Plan Amendment No. 13-003, Zone Change No. 13-005, and Tentative Tract Map No. 18881.
C.Approve a Project of 179 Medium Density Single-Family Lots to be Located on the Northeast Corner of Sierra Avenue and Segovia Lane (Sierra Crest II) (General Plan Amendment No. 13-010, Zone Change No. 13-013, Tentative Tract Map No. 13-011, and Administrative Site Plan No. 14-020)
1.  Find that the project will not have a significant effect on the environment, adopt the Mitigated Negative Declaration, Mitigation Monitoring Program and direct staff to file a Notice of Determination pursuant to the California Environmental Quality Act;

2.  Waive further reading of and introduce Ordinance No. _______, an Ordinance of the City of Fontana approving Zone Change No. 13-013, a zone change to the Zoning District Map to change approximately 39.4 gross acres of property (APNs: 0239-101-14, 0239-095-02, -07, and -10) from Multi-Family Residential (R-3) and General Commercial (C-2) to Medium Density Residential (R-2) and General Commercial (C-2), located on the northeast corner of Sierra Avenue and Segovia Lane and having a frontage of approximately 1127 feet on Sierra Avenue and an approximate frontage of 422 feet on Segovia Lane; and, that the reading of the title constitutes the first reading thereof; and,

3.  Approve Tentative Tract Map No. 13-011 (TTM No. 18944) and Administrative Site Plan No. 14-020, subject to the attached findings and conditions of approval.
D.Approve a Project of 200 Medium Density Single-Family Lots to be Located at the Southeast Corner of Baseline Avenue and Sierra Avenue (Gabriella) (General Plan Amendment No 13-007, Zone Change No.13-010; Tentative Tract Map No.13-010 (TTM18939)
1. Find that the project will not have a significant effect on the environment, adopt a Mitigated Negative Declaration, Mitigation Monitoring Program, and direct staff to file a Notice of Determination pursuant to the California Environmental Quality Act;

2. Waive further reading of and introduce Ordinance No. _______, an ordinance of the City of Fontana approving Zone Change No. 13-010, a zone change to the Zoning District Map to change approximately 17 gross acres of property (APNs: 0241-091-24, -25, -29, and -64) from General Commercial (C-2) to Medium Density Residential (R-2), located near the southeast corner of Sierra Avenue and Baseline Avenue and having a frontage on the east side of Sierra Avenue of approximately 460 feet and a frontage on the south side of Baseline Avenue of approximately 1,016 feet; and that the reading of the title constitutes the first reading thereof; and,

3. Approve Tentative Tract Map No. 13-010 (TTM 18939), subject to the attached findings and conditions of approval.
E.Amend General Plan/Zoning Land Use and Development Code to Comply With Requirements of the State Department of Housing and Community Development (Housing Element) (General Plan Amendment No. 13-005, Zone Change No. 13-007, and Zoning Code Amendment No. 13-008)
1.  Determine that the project will have less than a significant impact on the environment with a Mitigated Negative Declaration and direct staff to file a Notice of Determination adopting the Mitigated Negative Declaration pursuant to Section No.15070 of the California Environmental Quality Act (CEQA);

2.  Waive further reading of and introduce Ordinance No. _____, an Ordinance of the City of Fontana approving Zoning Change No. 13-007, and Zoning Code Amendment No. 13-008, to change the zoning on approximately 18.8 gross acres of Single Family Residential (R-1) and Light Industrial (M-1) zoning to Multiple-Family Medium/High Density Residential (R-4), and to change the zoning on approximately 86.4 gross acres of Medium Density Residential (R-2), Multi Family Residential (R-3), General Commercial (C-1), and Regional Mixed Use (RMU) to Multiple-Family High Density Residential (R-5), and to establish an Emergency Shelter Overlay District (ESO) in two existing Light Industrial (M-1) zoned areas within the City, and to amend the Development Code to include language regulating developments within the proposed new zones and overlay district, and that the reading of the title constitutes the first reading thereof.

F.4th General Plan Update for 2014 (General Plan Amendment No. 13-005, 13-007, and 13-010)
Adopt Resolution No. 2014-____, a resolution of the City of Fontana:

1.  Approving General Plan Amendment No. 13-005, an amendment to the General Plan Land Use Map to create new multi-family general plan designations and an emergency shelter overlay.

2.  Approving General Plan Amendment No. 13-007, an amendment to the General Plan Land Use Map to change the existing land use designation on approximately 17.0 adjusted gross acres of property (APNs: 0241-091-24, -25, -29 and -64) from General Commercial (C-G) to Medium Density Residential (R-MF) located near the southeast corner of Baseline Avenue and Sierra Avenue.

3.  Approving General Plan Amendment No. 13-010, an amendment to the General Plan Land Use Map to change the existing land use designation on approximately 39.4 adjusted gross acres of property (APN: 0239-101-14, 0239-095-02, -07, and -10) from Multi-Family Residential (R-MF) to Medium Density Residential (R-M) and General Commercial (C-G) to Medium Density Residential (R-M) and General Commercial (C-G), located on the northeast corner of Sierra Avenue and Segovia Street and having a frontage of approximately 1127 feet on Sierra Avenue and an approximate frontage of 422 feet on Segovia Lane.

4.  (Dependent on the outcome of Public Hearing Item B):  Approving General Plan Amendment No. 13-003, an amendment to change the General Plan Land Use Designation from High-Density Residential (R-MF) to Medium-Density Residential (R-M), and adopt a Mitigated Negative Declaration and Mitigation Monitoring Program and direct staff to file a Notice of Determination.
