This is an opportunity for citizens to speak to the City Council for up to 5 minutes on items not on the Agenda, but within the City Council's jurisdiction. The Mayor and City Council reserve the right to adjust this time limit based on the number of speakers who wish to address the Mayor and City Council. The Council is prohibited by law from discussing or taking immediate action on non-agendized items.

All matters listed under CONSENT CALENDAR will be enacted by one motion in the form listed below. There will be no separate discussion on these items prior to the time Council votes on them, unless a member of the Council requests a specific item be removed from the Consent Calendar for discussion. A.Approval of Minutes
Approve the Minutes of the November 26, 2013 Regular City Council Meeting. 
B.Adoption of Ordinance No. 1682
Waive further reading of and adopt Ordinance No. 1682, an Ordinance of the City of Fontana approving Zone Change No. 13-006, changing the Zoning District Map of approximately 4.7adjusted gross acres of property (APN: 1110-391-02) from Single-Family Residential (R-1) to Medium Density Residential (R-2).
C.Final Acceptance of Subdivision Improvements for Tract No.'s 16572, 16577, and 16993
1. Accept as complete the Subdivision Improvements for Tract No. 16572 located north of Baseline Avenue and west of Juniper Avenue, Tract No. 16577 located south of Walnut Avenue and east of Cypress Avenue, and Tract No. 16993 located south of Miller Avenue and east of Beech Avenue.

2. Adopt Resolution No. 2013-____, accepting sewers in Tract No.'s 16572, 16577, and 16993 as part of the City sewer system.
D.Approve the I-15/Sierra Avenue Freeway Maintenance Agreement with Caltrans
Approve the I-15/Sierra Avenue Freeway Maintenance Agreement between the City of Fontana and the California State Department of Transportation (Caltrans). 
E.Authorize a Program Supplement Agreement with Caltrans for the Foothill Boulevard Median Improvements
Adopt Resolution No. 2013-_____authorizing the City Manager to execute Program Supplement Agreement No. N011 with the California Department of Transportation (Caltrans) for the Foothill Boulevard Median Improvements from Sierra Avenue to Mango Avenue Project, Federal-Aid Project No. HSIPLN-5307(020); Agreement No. 08-5307R.   
F.Comprehensive Annual Financial Report for Fiscal Year Ended June 30, 2013
Approve the City of Fontana's Comprehensive Annual Financial Report (CAFR) for Fiscal Year ended June 30, 2013.
G.Annual Report on Development Impact Fees
Adopt Resolution No. 2013-___ of the City Council of the City of Fontana, approving the Annual Report on Development Impact Fees and making findings as to unexpended funds.
H.Fontana Art Association Quarterly Report

Accept staff report.

A.Second Reading and Public Hearing for the Adoption of the 2013 Edition of the California Building Standards Code and Corresponding Base Model Codes
Adopt Ordinance No. 1681, an ordinance of the City of Fontana adding, amending and deleting certain articles, sections and subsections of Chapter 5 of the Code of the City of Fontana, California pertaining to the construction and maintenance of buildings, and the 2013 Edition of the California Building Standards Code, known as the California Code of Regulations, Title 24, consisting of the California Building Code, Volumes 1 & 2, based on the 2012 International Building Code; the California Plumbing Code, based on the 2012 Uniform Plumbing Code; the California Electrical Code, based on the 2011 National Electrical Code; the California Mechanical Code, based on the 2012 Uniform Mechanical Code; the California Existing Building Code, based on the 2012 International Existing Building Code; the California Green Building Standards Code; the California Residential Code, based on the 2012 International Residential Code; and the 1997 Edition of the Uniform Administrative Code; and that the reading of the title constitute the second reading thereof.
B.User Fees for City Services
Adopt Resolution No. 2013-____ adopting certain new fees and increasing, decreasing or deleting certain existing fees for various City services.
C.Quarterly Lien Action for Delinquent Sewer, Rubbish and Weed Abatement Accounts
1. Authorize staff to complete and record lien notices against real property for those sewer accounts sixty days or more delinquent as described in the Certified Lien List and direct staff to forward recorded liens to the County for collection.

2. Authorize staff to complete and record liens against real property for those rubbish accounts more than ninety days delinquent as described in the certified Lien List and direct staff to forward recorded liens to the County for collection.

3. Adopt Resolution No. 2013-___ of the City Council of the City of Fontana adopting the statement of unpaid expenses for weed abatement and imposing a lien against real property for payment thereof.
D.General Plan Amendment No. 11-002, Zone Change No. 11-002, Design Review No. 11-003 - Central Park Project - Cypress Avenue
 1. Adopt Resolution No. 2013-___, a Resolution of the City of Fontana, adopting a statement of facts and findings, adopt a Statement of Overriding Considerations certifying the Final Environmental Impact Report (FEIR) (State Clearinghouse No. 2011051039), prepared for the Central Park Project (General Plan Amendment No. 11-002, Zone Change No. 11-002 and Design Review No. 11-003), approve the Mitigation Monitoring Plan, and, direct staff to file a Notice of Determination and find that:   The Final EIR has been completed in compliance with CEQA, the State guidelines, and the City’s guidelines; The City Council has reviewed and analyzed the Final EIR before approving the project; and, the Final EIR reflects the independent judgment of the City.

2. Adopt Resolution No. 2013-___, approving General Plan Amendment No. 11-002, a request to amend the land use designation from Medium Density Residential (R-M) to Public Facilities (P-PF) on approximately 4.4 adjusted gross acres of property and from Single-Family Residential (R-SF) to Public Facilities (P-PF) on approximately 3.3 adjusted gross acres of property;

3. Waive further reading of and introduce Ordinance No. ____, an Ordinance of the City of Fontana approving Zone Change No. 11-002, a request to change the zoning district from Medium Density Residential (R-2) to Public Facilities (P-PF) on approximately 4.4 adjusted gross acres of property and from Single-Family Residential (R-1) to Public Facilities (P-PF) on approximately 3.3 adjusted gross acres of property, and that the reading of the title constitutes the first reading thereof; and,
